Terms and conditions

Preamble

These general conditions govern the purchase of products made remotely through the website milkywayshop.it and related domains, owned by Nuova Corti Shop S.r.l., with headquarters at Via Palestro 19, 41049 Sassuolo (MO) — tel. +39 0536 802075. Purchase transactions are regulated by Legislative Decree no. 206/2005 (Consumer Code), while privacy protection is governed by EU Regulation 2016/679 and Legislative Decree 196/2003.

Art. 1 — Acceptance of sales conditions

The conditions set out in the preamble are an integral and essential part of the contract. Contracts are concluded directly when you access the website and follow the instructions and procedures provided. You should review these conditions online before completing your purchase: submitting your order confirmation means you have full knowledge of and agree completely to these terms.

Art. 2 — Selling prices and purchasing methods

All prices shown on the website are in euros and include VAT and any other taxes. Shipping costs, when applicable, are your responsibility and will be shown before order confirmation. The contract is concluded when you correctly complete the form and give your consent to purchase online. You can pay using the methods shown at checkout (see the "Payment methods" section).

Art. 3 — Shipping methods

Nuova Corti Shop S.r.l. delivers ordered products to the address you provide, using express courier or other goods handling services. For accessories, helmets, shoes and clothing, shipping within Italy (including islands) is free for orders over €149; below this threshold a shipping fee is shown at checkout. Complete bikes and frames ship with dedicated packaging and insurance and have a dedicated shipping rate, calculated and shown at checkout before order confirmation. International shipping is available for accessories in countries shown at checkout; for bikes and frames abroad, shipping is quoted upon request. Free in-store pickup is also available in Sassuolo, subject to availability confirmation. For tubeless bikes, sealant is not inserted in the rim to prevent leakage during transport. Failed delivery due to customer fault. You must provide a complete and correct delivery address and a reachable phone number. If delivery fails due to wrong or incomplete address, recipient absence at delivery attempts, or failure to pick up within the carrier's stated timeframe, actual storage costs (€10 for the first 10 days, €20 for each subsequent day), redelivery costs, or return shipping costs (equal to the shipping rate applied to your order) are your responsibility. In case of order cancellation or exercise of your right of withdrawal, such documented costs will be deducted from your refund; product prices and initial shipping fees remain refunded as required by the Consumer Code.

Art. 4 — Liability

Nuova Corti Shop S.r.l. does not assume responsibility for service failures due to force majeure (accidents, explosions, fires, strikes, earthquakes, floods and similar events) that prevent, wholly or partially, contract performance within agreed timeframes. The Company is not responsible for fraudulent use of credit cards or other payment methods by third parties: at no point in the purchase procedure does the Company have access to card data, which is transmitted via a secure connection directly to the payment service provider.

Art. 5 — Warranties and assistance

Nuova Corti Shop S.r.l. sells high-quality products. All products are covered by 24-month legal warranty of conformity under the Consumer Code; manufacturers may offer additional conventional warranties. Warranty begins on the day of purchase.

Art. 6 — Returns and withdrawal

Returns and the right of withdrawal are governed by applicable law and the procedures described in the dedicated "Returns and refunds" page. You can exercise your right of withdrawal within 14 days of receiving the product.

Art. 7 — Buyer's obligations

You are forbidden from entering false, made-up or fictitious data in the registration and order procedure. You are solely responsible for correctly entering your data and release the Company from any liability resulting from incorrect tax documents issued due to inaccurate data you provide.

Customer rights and obligations

To use the website you must: have the legal capacity to enter into binding contracts under Italian law; fully accept these sales conditions; provide correct and real data during registration and ordering (personal details for billing, valid email address). By confirming an order, you declare that you understand and accept the terms of the sales service and authorize processing of your data according to our Privacy Policy. Keep your order confirmation email and you can withdraw according to the timeframes and methods shown in the "Returns and refunds" page.

Payment methods

The following payment methods are available:

• Credit/debit card — via Stripe, on encrypted SSL connection. The Company neither receives nor stores card data.
• PayPal — even without a PayPal account, using your own card.
• Advance bank transfer — your order is processed after payment is received. Payee: Nuova Corti Shop S.r.l. — INTESA SANPAOLO — IBAN IT70K0306967017100000004816.
• HeyLight installment payment — on selected products, when available.

Italian law and competent court

Nuova Corti Shop S.r.l. operates under Italian legislation and, for any dispute, refers to the Court of Modena. Website content may not comply with regulations applied in other countries; access from countries where the content violates local law is prohibited.

Alternative dispute resolution (ADR)

Under the Consumer Code (Legislative Decree 206/2005, art. 141 et seq.), if you have filed a complaint directly with the seller without finding a satisfactory solution, you can use alternative dispute resolution (ADR) procedures at competent bodies at no cost or low cost, including conciliation procedures at the local Chamber of Commerce. Orders

Nuova Corti Shop S.r.l. reserves the right to refuse orders if the payment processor does not provide authorization, or to refuse service to anyone at any time. Working closely with suppliers, availability shown may not be actual: we invite you to contact us for up-to-date information.

Content responsibility

All product and brand content is provided directly by manufacturing and/or distribution companies: the Company is not responsible for any discrepancies in product sheets; if you report any inaccuracies we will make corrections. Website information complies with Italian legislation. The Company reserves the right to modify portal content at any time, including these terms: we recommend you check periodically for updates.
